July 7, 2020 – The state has filed manslaughter charges in Cherokee County in connection with the fatal shooting of a man at a Tahlequah park on June 3.

Assistant District Attorney Eric Jordan is listed as lead prosecutor on the first-degree manslaughter case against Richard Lee Smith, 55, of Park Hill.

Tahlequah police responded to a report of a shooting Riverside Park on June 3. They arrived to find Dayne Whitehorn, 25, unresponsive to a bystander’s attempts at CPR. He was transported to a nearby hospital where he later died.

Witnesses told investigators Whitehorn had been fighting with Smith when the shot was fired.

In a report filed by the Tahlequah Daily Press, District 27 District Attorney Jack Thorp said Smith, “unlawfully, willfully, knowingly, and wrongly” committed the crime of first-degree manslaughter in the shooting death of Whitehorn.
